Commerce published affirmative LTFV and CVD finals on August 31, 2026 (91 FR 55837; 91 FR 55840). On October 15, 2026 the ITC notified Commerce of final affirmative injury determinations. The ITC determinations notice published October 20, 2026 (91 FR 66359; FR Doc. 2026-21382). Background on the ITC finals and Commerce rates is in Van-type trailers China: ITC final injury. This article covers the orders and deposit timing.

Rates and cash deposits

The China-wide AD weighted-average dumping margin is 130.86% (adverse facts available), with a cash deposit rate of 129.73% after the export subsidy offset. CVD subsidy rates are 134.75% (AFA) for each listed company, including CIMC Baowell Industries Co., Ltd. and Qingdao CIMC Reefer Trailer Co., Ltd., and 134.75% for all others. Effective on the date of publication of the ITC's final affirmative injury determination, CBP requires cash deposits at these rates when importers would normally deposit estimated customs duties.

Assessment windows and provisional gaps

AD duties are assessed on unliquidated entries entered or withdrawn for consumption on or after June 15, 2026 (LTFV preliminary publication), excluding the provisional-measures gap. CVD duties apply on or after June 5, 2026 (CVD preliminary publication), with the same gap structure.

  • AD gap: the order states the four-month provisional period ended October 12, 2026, and identifies October 16, 2026 as the first day provisional measures were no longer in effect. CBP liquidates without regard to AD duties entries on or after October 16, 2026 through the day preceding publication of the ITC final injury determination.
  • CVD gap: the four-month period ended October 2, 2026. CBP liquidates without regard to CVD duties entries on or after October 3, 2026 through the day preceding the ITC final publication.
  • Resumption: suspension of liquidation and cash deposits resume on the date of publication of the ITC final. The ITC determinations notice published October 20, 2026 (91 FR 66359), so by our reading of the order's gap rule the excluded windows run through October 19, 2026.

Scope (high level)

Covered merchandise includes van-type trailers and listed subassemblies with GVWR greater than 26,000 pounds, whether finished or unfinished, assembled or unassembled. Components entered on the same bill of lading as in-scope trailers or subassemblies are covered. Processing in a third country does not remove the product from scope. Subassemblies covered by the China chassis AD/CVD orders are excluded. HTSUS subheadings for convenience only: 8716.39.0040, 8716.39.0090, 8716.90.5060; subassemblies may also enter under 7308.30.5050, 7308.90.9590, 7326.90.8688, 8708.29.1500, 8708.99.8180, 8716.90.5010. The written scope controls.

Annual inquiry service list

Interested parties that want to be added to the annual inquiry service list must submit an entry of appearance in ACCESS within 30 days after publication of the order. By our count from the October 28, 2026 publication date, that deadline is November 27, 2026. ACCESS: https://access.trade.gov.

Drawback note

AD and CVD duties are not drawback-eligible (19 U.S.C. 1677h). Ordinary customs duties on the same entries can still be drawback-eligible when merchandise is exported or destroyed (or used to manufacture exported goods) and the claim otherwise qualifies. See AD/CVD drawback exclusion and how to file a duty drawback claim.
