Vietnam copper pipe AD: first sunset finals
Expedited first sunset. Commerce dumping half only. ITC still decides injury. Keep AD deposits in landed cost.
Commerce finds that revocation of the antidumping duty order on seamless refined copper pipe and tube from Vietnam would be likely to lead to continuation or recurrence of dumping at weighted-average margins up to 8.35% (A-552-831). The final results of the expedited first sunset review were placed on public inspection October 27, 2026 at 8:45 a.m. and are scheduled for publication October 28, 2026 (FR Doc. 2026-21930). Dated October 22, 2026, Scot Fullerton. Contact: Catherine Bonilla, (202) 482-7955.
Commerce: revocation would likely lead to dumping up to 8.35%. That is a likely margin if revoked, not a new cash deposit rate. ITC still decides injury.
What Commerce decided (and what it is not)
Under sections 751(c) and 752(c), Commerce determines likelihood of continuation or recurrence of dumping and the magnitude of margins likely to prevail if the order were revoked. The 8.35% figure is that likely-to-prevail magnitude. It is not a new cash deposit rate. Deposit rates stay as required at entry unless and until a separate continuation, revocation, or review notice changes them.
Sunset has two halves. Commerce decides dumping; the ITC separately decides likelihood of injury. The order stays in place unless revoked after both agencies complete their reviews. This notice does not announce an ITC determination or date, and this article does not invent one. For how the five-year clock works on the importer side, see the five-year clock. As an example of a later Commerce continuation after sunset findings, see Mexico steel welded wire mesh AD/CVD first sunset continuation (a different product and proceeding).
