The U.S. International Trade Commission determined that a U.S. industry is materially injured by reason of less-than-fair-value and subsidized imports of van-type trailers and subassemblies from China (Inv. Nos. 701-TA-781 and 731-TA-1768 (Final)). FR Doc. 2026-21382 was filed for public inspection October 19, 2026 and is scheduled for publication October 20, 2026 (https://www.federalregister.gov/d/2026-21382). Determinations were completed and filed October 15, 2026; views are in USITC Publication 5797 (October 2026). Commissioners Bartholomew Thanhauser and Samuel Negatu did not participate.

ITC final affirmative injury on China van-type trailers and subassemblies. Commerce AD final: China-wide 130.86% (cash deposit 129.73%). CVD final: 134.75% across CIMC, non-responsive companies, and all others. Commerce is expected to issue AD and CVD orders.

Commerce AD and CVD finals (August 31, 2026)

Commerce's final affirmative LTFV determination (A-570-219; POR April 1, 2025 through September 30, 2025) assigned the China-wide entity 130.86% based on adverse facts available, with a cash deposit of 129.73% after the export subsidy offset. Canadian third-country ACE case numbers

For Chinese subassemblies and/or van-type trailers containing Chinese subassemblies imported through Canada, report under third-country case numbers A-122-219 (AD) and C-122-218 (CVD). Only the Chinese subassembly portion, plus components entering on the same bill of lading as the Chinese subassembly, is subject to China duties.

Drawback note

AD and CVD duties are not drawback-eligible (19 U.S.C. 1677h). Ordinary customs duties on the same entries can still be drawback-eligible when merchandise is exported or destroyed and the claim otherwise qualifies. See AD/CVD drawback exclusion.

Action items

  • Confirm Chinese origin for fleets, dealers, and trailer importers: finished units and subassemblies.
  • Budget for combined AD and CVD deposits at the China-wide / all-others finals until orders and any company-specific rates revise the picture.
  • Check Canadian-routed trailers with Chinese subassemblies under A-122-219 / C-122-218.
  • Watch for the AD and CVD orders in the Federal Register; keep entry-level documentation ready for CBP and ACE.
