FTZ Board: six production decisions (Oct 30)
Tesla 14-month and Baker Hughes two-year limits. Coroplast and StandardAero authorized. Stadler and AuroraTe need 400.23 applications.
The Foreign-Trade Zones Board decided six production-activity notifications under 15 CFR part 400: four authorized (Tesla, Baker Hughes, Coroplast Tape, and StandardAero) and two not authorized (Stadler US and AuroraTe). In each matter, the applicant was notified of the Board's decision on October 28, 2026. The six notices were placed on public inspection October 30, 2026 at 8:45 a.m. and are scheduled for publication November 2, 2026 (FR Docs. 2026-22301, 2026-22298, 2026-22344, 2026-22352, 2026-22300, 2026-22299). Signed by Colin Agostisi, Executive Secretary (Tesla/Baker Hughes/Stadler/AuroraTe dated October 28, 2026; Coroplast and StandardAero dated October 29, 2026).
FTZ Board: Tesla (14-month limit) and Baker Hughes (two-year limit) authorized on a limited basis; Coroplast and StandardAero authorized; Stadler and AuroraTe not authorized.
Notification versus application
These six matters began as notifications of proposed production activity under 15 CFR 400.22. When the Board decides no further review is warranted, it can authorize the described activity (subject to the FTZ Act and Board regulations, including section 400.14). "Limited basis" authorizations can carry time limits. When further review is warranted, the production activity described in the notification is not authorized; the applicant would need an application for production authority under section 400.23. The notices give no reasons for further review or for time limits; this article does not speculate. Background: Foreign-Trade Zones Board.

FTZ procedures and duty drawback are separate duty-management tools. Companies whose FTZ production activity was not authorized can still evaluate other options such as drawback where the requirements are met. Neither path invents specific savings from these notices alone. See five drawback types and how to file a duty drawback claim.
Action items
- Map authorized activity to the notice limits: Tesla under section 400.14 plus a fourteen-month limit; Baker Hughes under 400.14 plus a two-year limit; Coroplast and StandardAero under 400.14 with no stated time limit.
- Treat Stadler and AuroraTe as not authorized for the notified activity until a 400.23 application is filed and granted.
- Compare FTZ versus drawback as separate compliance designs; do not claim project-specific savings from these notices.

- Authorized limited: Tesla (Subzone 84AM battery storage, 14 months) and Baker Hughes (Subzone 53D ESP components, two years). Authorized without stated time limit: Coroplast Tape (Subzone 38W) and StandardAero (FTZ 80).
- Not authorized: Stadler US (Subzone 30G passenger rolling stock) and AuroraTe (FTZ 84 galvanized steel pipes). Further review warranted; 400.23 application path.
- FTZ and drawback are separate duty tools; denied FTZ production does not invent savings, and drawback remains a separate option where requirements are met.
