What a Timken notice does

Under Timken Co. v. United States, 893 F.2d 337 (Fed. Cir. 1990), as clarified by Diamond Sawblades, 626 F.3d 1374 (Fed. Cir. 2010), Commerce must publish a notice when a court decision is not in harmony with its determination. The notice treats the CIT judgment as final for that purpose. Commerce is amending the final determination and the resulting AD order with respect to Galvasid and all other producers and/or exporters, and will issue revised cash deposit instructions to CBP.

The notice does not restate the earlier margins. This article does not state or estimate prior rates, and does not say whether the amended rates went up or down.

Drawback note

Antidumping duties are not drawback-eligible (19 U.S.C. 1677h). Ordinary customs duties on the same CORE entries can still qualify when merchandise is exported or destroyed (or used to manufacture exported goods) and the claim otherwise qualifies. See AD/CVD drawback exclusion and how to file a duty drawback claim.

Action items

  • Update deposit modeling to Galvasid 14.54% and All Others 14.29% for Mexico CORE entries, effective applicable date October 29, 2026.
  • Watch for revised CBP cash deposit instructions implementing the amended order rates.
  • Keep Timken timing distinct from publication: the amended rates are applicable October 29, 2026; the FR notice itself is scheduled for November 2, 2026.
