Wind towers: India/MY/Spain AD, India CVD sunsets
Likely-to-prevail rates for the ITC, not new cash deposits. Orders stay in effect pending separate ITC sunset determinations.
Commerce issued expedited first sunset final results on the antidumping duty orders on utility scale wind towers from India, Malaysia, and Spain, and on the countervailing duty order on utility scale wind towers from India. The AD notice (FR Doc. 2026-22530; A-533-897, A-557-821, A-469-823) is dated October 30, 2026. The India CVD notice (FR Doc. 2026-22527; C-533-898) is dated October 29, 2026. Both are signed Scot Fullerton and are scheduled for publication in the Federal Register on November 4, 2026 (public-inspection PDFs linked in sources). Commerce finds that revocation would likely lead to continuation or recurrence of dumping and of countervailable subsidies.
AD likely-to-prevail margins: up to 54.03% India, 3.20% Malaysia, 73.00% Spain. India CVD likely rates: Vestas 2.25%; named group 397.70%; All Others 2.25%. Not new cash deposits.
Orders and expedited path
AD order on Spain published August 16, 2021; AD orders on India and Malaysia December 6, 2021; CVD order on India December 6, 2021. Sunset reviews initiated July 2, 2026. Domestic interested parties filed notices of intent July 17, 2026 and adequate substantive responses August 3, 2026. No respondent interested party filed a substantive response. Commerce notified the ITC August 24, 2026 and conducted expedited 120-day reviews. The domestic party for the India CVD review was the Wind Tower Trade Coalition.
These AD and India CVD finals sit beside Commerce's separate Malaysia wind towers CVD expedited first sunset final (Malaysia wind towers CVD: first sunset finals, likely rate 6.43%). The ITC's parallel sunset work on wind towers (expedited track) is covered in ITC sunsets: twist ties, wind towers, chassis.

What these rates mean (and do not)
Under sections 751(c) and 752 of the Act, Commerce reports the dumping margins and net countervailable subsidy rates likely to prevail if the orders were revoked. AD: up to 54.03% India, 3.20% Malaysia, 73.00% Spain. CVD India: Vestas Wind Technology India Private Limited 2.25%; Naiks Brass & Iron Works, Nordex India Pvt, Prommada Hindustan, Suzlon Energy, Vinayaka Energy Tek, Wish Energy Solutions Pvt Ltd, and Zeeco India Pvt. Ltd 397.70%; All Others 2.25%. Those figures are what Commerce reports to the ITC for the likelihood analysis. They are not new cash deposit rates, and these notices do not change current cash deposits. The orders stay in effect while the ITC completes its separate sunset determinations.
ACCESS hosts the Issues and Decision Memoranda (access.trade.gov). The notices' DATES lines say applicable on the date of Federal Register publication (by our reading, November 4, 2026).
Action items
- Treat these percentages as Commerce's sunset "likely to prevail" rates for the ITC, not as revised deposit instructions.
- Keep tracking India, Malaysia, and Spain utility-scale wind tower entries under the existing AD/CVD orders and cash deposits until any later continuation or revocation notice.
- Watch the ITC's separate sunset determinations for the injury-side outcome that decides whether each order continues.
Antidumping and countervailing duties are not drawback-eligible (19 U.S.C. 1677h; see AD/CVD duties are excluded from drawback). Ordinary customs duties on the same entries can still be drawback-eligible when merchandise is exported or destroyed (or used to manufacture exported goods) and the claim otherwise qualifies (how to file a duty drawback claim).
