Issues under review

The Commission is reviewing: (1) construction of the preamble of claim 13 of the '714 patent and related infringement and technical-prong findings; (2) indirect infringement by ASUS of claim 13 of the '714 patent; (3) certain '973 claim elements on infringement and the technical prong; (4) written description and obviousness of the '973 patent; and (5) the economic prong of domestic industry. Invalidity findings for the '714 patent are not under review and are adopted. The Commission also posed discrete briefing questions, including on the meaning of "plant and equipment" and "employment of labor or capital" in section 337(a)(3)(A) and (B).

Remedy, public interest, and bonding window

Parties, interested government agencies, and other interested persons may file written submissions on remedy, the public interest, and bonding. Initial submissions and proposed remedial orders are due by close of business November 12, 2026; replies by November 19, 2026. Complainant is asked to identify the remedy sought, supply proposed remedial orders, provide HTSUS subheadings for accused products, and identify known importers. Non-confidential filings are available for public inspection on EDIS. If a remedy issues, USTR has 60 days for Presidential review during which subject articles may enter under bond.

This is a partial review of a violation finding, not a final Commission violation determination and not a remedy order. A parallel Commission review-and-briefing posture in another 337 matter is covered in PVDF resins 337-TA-1439 Commission review. A section 337 exclusion order, if any later issues, would affect whether goods can enter; that entry bar is separate from duty recovery under drawback (how to file a duty drawback claim).
