Vaporizer 337: Glas public-interest window
ALJ recommended LEO and CDO vs Glas respondents. Commission has not decided violation. Public comments due close of business Nov 19.
The U.S. International Trade Commission is soliciting public-interest submissions in Investigation No. 337-TA-1464 (Certain Vaporizer Devices, Cartridges Used Therewith, and Components Thereof). On October 20, 2026, the presiding ALJ issued an Initial Determination on Violation of Section 337 and a Recommended Determination on Remedy and Bond. The notice was placed on public inspection October 26, 2026, and is scheduled for publication October 27, 2026 (FR Doc. 2026-21885). Issued October 23, 2026. Contact: Joelle Justus, Esq., Office of the General Counsel, (202) 205-2593.
ALJ recommended LEO and CDO vs Glas. Commission seeks public-interest comments by close of business November 19, 2026. No Commission violation decision yet.
Recommended relief (not yet a Commission order)
The recommended relief includes a limited exclusion order directed to vaporizer devices, cartridges used therewith, and components thereof imported, sold for importation, and/or sold after importation by respondents Glas, Inc. and Glas, LLC that infringe claims 1, 5, 7, 15-16, and 18-21 of U.S. Patent No. 11,134,722 and claims 1, 5, and 8 of U.S. Patent No. 11,606,981, plus a cease and desist order directed to the Glas respondents. Parties file public-interest submissions under 19 CFR 210.50(a)(4).
A limited exclusion order, if issued after a Commission finding of violation, is enforced by CBP at the border against covered imports. A cease and desist order can reach domestic inventory and sales activity by named respondents. Neither has issued yet. The Commission has not decided whether there is a violation. What public-interest comments should address
Members of the public and interested government agencies may file submissions of no more than five pages, inclusive of attachments, on whether recommended remedial orders would affect U.S. public health and welfare, competitive conditions, production of like or directly competitive articles, or U.S. consumers. In particular, the Commission wants comments that:
- (i) Explain how the articles potentially subject to the recommended orders are used in the United States.
- (ii) Identify any public health, safety, or welfare concerns relating to the recommended orders.
- (iii) Identify like or directly competitive articles that complainant, its licensees, or third parties make in the United States that could replace the subject articles if excluded.
- (iv) Indicate whether complainant, licensees, and/or third-party suppliers have capacity to replace the volume within a commercially reasonable time.
- (v) Explain how the recommended orders would impact U.S. consumers.
Written submissions are due no later than close of business on November 19, 2026. File electronically on EDIS citing "Inv. No. 337-TA-1464". Confidential treatment follows 19 CFR 201.6(b) and 210.5(e)(2). The source does not name the complainant; this article does not invent one.
If an exclusion order issues, covered goods would be refused entry at the border. That is an entry bar, not a duty-refund event. Ordinary customs duties on other eligible merchandise remain subject to the usual drawback rules when the claim otherwise qualifies.
