What rescission means for 2025 entries

Under 19 CFR 351.213(d)(3), Commerce rescinds a CVD admin review when there are no suspended entries of subject merchandise during the POR for an exporter or producer under review. After the withdrawals and the no-entry finding for the remaining companies, Commerce rescinded the review in its entirety. Cash deposit rates do not change. Commerce will instruct CBP to assess CVD on appropriate entries at rates equal to the cash deposit of estimated CVD required at the time of entry, or withdrawal from warehouse, for consumption (19 CFR 351.212(c)(1)(i)). Assessment instructions issue no earlier than 35 days after publication (by our count, no earlier than November 30, 2026).

Drawback note

CVD duties are not drawback-eligible (19 U.S.C. 1677h). Ordinary customs duties on the same entries can still qualify when merchandise is exported or destroyed (or used to manufacture exported goods) and the claim otherwise qualifies. See AD/CVD drawback exclusion and how to file a duty drawback claim.

Action items

  • Expect liquidation at deposit rates: CAAS importers should expect 2025 POR entries to liquidate at the CVD cash deposit rates required at entry.
  • Reconcile deposits paid: close out 2025 review expectations; no company-specific assessment rates will come from this segment.
  • Keep current deposits in landed cost: rescission does not change ongoing cash deposit requirements under the order.
