Commerce initiates August-anniversary AD/CVD admin reviews
Initiation package for August-anniversary orders (distinct from the October opportunity notice). Wind towers, China tires, pea protein, brake drums, flanges, fish fillets.
Commerce initiates administrative reviews of AD and CVD orders with August anniversary dates. Applicable October 1, 2026 (91 FR 62477; FR Doc. 2026-20160). Final results are intended not later than August 31, 2027. This is initiation of reviews already requested, distinct from the October opportunity-to-request notice (October anniversary opportunity).
August-anniversary reviews are now live. Respondent selection within 35 days of publication. Separate Rate filings for NME proceedings due within 14 calendar days. Withdrawal window: 90 days under 19 CFR 351.213(d)(1).
Deadlines that matter first
- Respondent selection. Commerce intends to select from CBP data or Q&V questionnaires, place that data on the record within five days of initiation publication, and decide within 35 days. Comments on CBP/Q&V within seven days after placement; rebuttal five days after the initial-comment deadline.
- Separate rates (NME). Separate Rate Certifications and Applications are due no later than 14 calendar days after publication of this initiation notice.
- No sales. For AD reviews, a producer or exporter with no exports, sales, or entries during the POR may notify Commerce within 30 days of publication.
- Withdrawal. A party that requested review may withdraw within 90 days of initiation publication (19 CFR 351.213(d)(1)), subject to case-by-case extension.

Initiation locks company-specific case numbers into the review. Cash deposits stay in place until final results and CBP assessment instructions. If your exporter is named, track respondent selection, separate-rate clocks, and any no-sales notification. AD/CVD assessments remain generally outside drawback (AD/CVD drawback exclusion). Do not conflate this initiation package with the October opportunity-to-request notice; that window is for a different anniversary month.
