What the Commission must decide

Under sections 703(a) and 733(a) of the Tariff Act of 1930, the Commission will determine whether there is a reasonable indication that a U.S. industry is materially injured or threatened with material injury, or that establishment of an industry is materially retarded, by reason of imports of wooden fence pickets from China alleged to be sold at LTFV and alleged to be subsidized by the Government of China.

Petitioners and calendar

The petition was filed on September 24, 2026, by the American Alliance of Wooden Fence Producers, comprised of Alta Forest Products (Chehalis, Washington); Sierra Pacific Industries (Anderson, California); and Mendocino Forest Products (Santa Rosa, California).

Unless Commerce extends the time for initiation, the Commission must reach a preliminary determination in 45 days, or by November 9, 2026. The Commission's views must be transmitted to Commerce within five business days thereafter, or by November 17, 2026.

This is institution and scheduling of the ITC preliminary phase. It is not a Commerce LTFV or subsidy determination and does not by itself set cash deposit rates. If AD/CVD orders eventually issue, those deposits and assessed duties remain generally outside drawback (AD/CVD drawback exclusion).
