Commerce issues a final affirmative circumvention determination that Zongshen engine models 5C65M0 and BC70M0 are later-developed merchandise circumventing the AD and CVD orders on certain vertical shaft engines between 99cc and up to 225cc, and parts thereof, from China. Merchandise and procedural path

Inquiry merchandise is engine models 5C65M0 and BC70M0 produced by Chongqing Zongshen General Power Machine Co., Ltd. (Zongshen) in China. Commerce initiated under section 781(d) on July 11, 2025, published a Preliminary Determination on May 18, 2026, and now affirms that those models, when imported into the United States, circumvent the Orders.

Based on analysis of comments received, Commerce made no changes to the Preliminary Determination. The final continues the same affirmative later-developed merchandise finding for both models.

Under 19 CFR 351.226(l)(3)(i)–(ii), Commerce will direct CBP to continue suspension of liquidation of previously suspended entries and apply the applicable cash deposit rate, and to suspend liquidation and require estimated AD and CVD cash deposits for each unliquidated entry of those Zongshen models not yet suspended that is entered, or withdrawn from warehouse, for consumption on or after July 11, 2025.

AD/CVD cash deposits and assessed antidumping or countervailing duties remain generally outside drawback (AD/CVD drawback exclusion).
