FR Doc. 2026-22378 · DN 3945 shrimp · filed Oct 28, 2026 · public interest: 8 calendar days after FR publication
Shrimp: DN 3945 complaint received
Complaint and 210.8(b) submission filed October 28, 2026 on behalf of Versaggi Shrimp Corp. and W&W Dock LLP. The notice alleges Section 337 violations in the importation and sale of certain shrimp and products containing same; it does not state the legal theory, so do not treat this as a patent case from the notice alone. This is separate from AD orders on shrimp.
Proposed respondents: Nekkanti Sea Foods Ltd. (India); Eastern Fish Company (Teaneck, NJ); ALDI SÜD Dienstleistungs-SE & Co. oHG (Germany); ALDI Inc. (Batavia, IL); Koninklijke Ahold Delhaize N.V. (Netherlands); Ahold Delhaize USA (Quincy, MA); and Meijer, Inc. (Grand Rapids, MI). Complainants request a limited exclusion order, cease and desist orders, and a bond during the 60-day Presidential review period (19 U.S.C. 1337(j)). The Commission has not decided whether to institute.
Public interest comments: due by close of business eight calendar days after Federal Register publication, five-page limit, Docket No. 3945; replies three calendar days after the comment due date (19 CFR 201.14(a) last-day rules still apply). By our count, eight days after November 3 is November 11, 2026 (Veterans Day, a federal holiday), so the deadline would roll to the next business day, November 12, 2026, by our count. Confirm with the Commission.
Action items and customs note
- Magnet wire importers: watch 337-TA-1527 service and the 20-day response clock; track whether any later limited exclusion order issues.
- Shrimp supply chains named in DN 3945: calendar the public interest window and watch for an institution notice.
- Do not treat institution or complaint receipt as an exclusion order. Confirm any entry holds with counsel and CBP once a remedy, if any, issues.
A Section 337 exclusion order, if any, affects whether goods can enter. That is separate from duty recovery. Ordinary customs duties on qualifying entries can still be drawback-eligible when merchandise is exported or destroyed (or used to manufacture exported goods) and the claim otherwise qualifies (how to file a duty drawback claim).

- Institution/complaint receipt is not an exclusion order. Any later 337 exclusion order affects entry, which is separate from duty recovery.
