Commerce published final results for the countervailing duty administrative review of certain hot-rolled steel flat products from the Republic of Korea (C-580-884) covering January 1 through December 31, 2023. The notice is applicable October 9, 2026 (91 FR 64635; FR Doc. 2026-20778).

Order: 81 FR 67960 (October 3, 2016). Preliminary results: 91 FR 18398 (April 10, 2026). Changes since the preliminary results were made to POSCO's subsidy-rate calculation only. Korean hot-rolled can also be covered by a separate AD order; this notice is CVD-only.

Final CVD rates: Hyundai Steel Company 1.28% ad valorem; POSCO 3.68%. Cash deposits at these rates for entries on or after October 9, 2026.

Issues decided and cash-deposit effects

The Issues and Decision Memorandum addresses, among other comments: whether electricity is subsidized by More Than Adequate Remuneration (MTAR); Korea Emissions Trading System (K-ETS) permits; attribution of electricity-for-MTAR benefits received by POSCO International; KEXIM Overseas Investment Credit Program and Export Growth Loan benchmarks; and the workplace nursery program.

  • Cash deposits: Commerce will instruct CBP to collect estimated CVD cash deposits at the rates above for shipments of subject merchandise entered, or withdrawn from warehouse, for consumption on or after October 9, 2026 (publication of these final results). Non-reviewed firms keep their most recent company-specific rate or the all-others rate, as appropriate.
  • Assessment: Commerce intends to issue assessment instructions to CBP no earlier than 35 days after publication, which by our count is November 13, 2026. A timely CIT summons can hold liquidation through the 90-day injunction window.
Drawback

CVD assessments and cash deposits are not drawback-eligible (19 U.S.C. § 1677h; see AD/CVD drawback exclusion). Confirm C-580-884 on Korean hot-rolled entries and keep any companion AD case number on a separate track. Ordinary customs duties on the same entries can still be drawback-eligible when merchandise is exported or destroyed.
