Fatty acids from Indonesia: preliminary AD margins and 90-day critical-circumstances risk

Commerce preliminarily finds LTFV sales of certain fatty acids from Indonesia, with company-specific margins, CVD export-subsidy offsets, and a 90-day critical-circumstances lookback only for all other exporters and producers.

Commerce preliminarily finds that certain fatty acids from Indonesia are being, or are likely to be, sold in the United States at less than fair value. The notice is applicable September 22, 2026 (91 FR 60096; FR Doc. 2026-19378). Critical circumstances are affirmative only for all other exporters and producers, which can pull suspension back 90 days before publication for that cohort.

Preliminary margins and cash deposits

Commerce calculated the following estimated weighted-average dumping margins and subsidy-offset cash deposit rates:

Cash deposit rates are adjusted for export-subsidy offsets from the companion CVD proceeding while CVD provisional measures remain in effect. If those CVD provisional measures expire first, Commerce will direct CBP to collect AD cash deposits unadjusted for countervailed export subsidies.

Critical circumstances, in part

Commerce preliminarily finds that critical circumstances do not exist for Musim Mas (P.T. Musim Mas and PT Inti Benua Perkasatama) or PT Wilmar Nabati Indonesia. Critical circumstances do exist for all other exporters and producers. For that all-others cohort, suspension of liquidation may reach unliquidated entries entered, or withdrawn from warehouse, for consumption on or after the date that is 90 days before publication of this preliminary determination.

Suspension starts at publication for named respondents

For Musim Mas and PT Wilmar, suspension of liquidation and cash deposits run from publication of the preliminary determination. The 90-day lookback attaches to the all-others critical-circumstances finding, not to the individually examined entities for which Commerce found critical circumstances do not exist.

Final postponed; provisional measures extended

At the exporters' request, Commerce is postponing the final determination up to 135 days after publication of the preliminary determination and extending provisional measures from four months to a period not greater than six months. Musim Mas and PT Wilmar separately requested that postponement between September 3 and September 4, 2026.

Scope summary

Subject merchandise is certain fatty acids with carbon chain lengths C6, C8, C10, C12, C14, C16, or C18, an iodine value below 105 g/100 g, and a degree of split (free fatty acids to triglycerides) of at least 97 percent, including single fatty acids and blends of those chain lengths. HTSUS examples in the FR appendix include 2915.70.0110, 2915.70.0120, 2915.70.0150, 2915.90.1010, 2915.90.1050, 2916.15.1000, 2916.15.5100, 3823.11.0000, 3823.12.0000, 3823.19.2000, and 3823.19.4000, and merchandise may also enter under 3824.99.4190. The written scope is dispositive.

AD cash deposits and assessed antidumping duties remain generally outside drawback under 19 U.S.C. § 1677h and 19 CFR § 190.3 (AD/CVD drawback exclusion).
