Commerce published a correction to the antidumping duty orders on dioctyl terephthalate (DOTP) from Malaysia, Poland, Taiwan, and the Republic of Turkiye on October 20, 2026 (91 FR 66295; FR Doc. 2026-21457; A-557-827, A-455-808, A-583-875, A-489-852). The notice is dated October 15, 2026 (signed by Scot Fullerton). It corrects dates in the May 22, 2025 orders (90 FR 21897; FR Doc. 2025-09163).

Corrected: provisional measures ended May 3, 2025; gap starts May 4, 2025. Reading both notices together, the AD-free gap runs May 4 through May 14, 2025.

What the May 2025 orders said, and what changed

The May 22, 2025 orders stated that the six-month provisional measures period (from the November 5, 2024 preliminary determinations) ended May 4, 2025, and that suspension of liquidation terminated for entries on or after May 5, 2025. The October 2026 correction says the correct dates are May 3, 2025 (end of provisional measures) and May 4, 2025 (start of the gap / termination of suspension due to expiration of provisional measures).

Under the original order, entries entered or withdrawn from warehouse for consumption in the gap through May 14, 2025 (the day before the ITC final determinations were published May 15, 2025, 90 FR 20688) are liquidated without regard to antidumping duties, and suspension and cash deposits resumed May 15, 2025. Combining the corrected start date with the original order's end date, we read the two notices together to mean the gap period runs May 4 through May 14, 2025.

Drawback note

AD duties are not drawback-eligible (19 U.S.C. 1677h). Ordinary customs duties on DOTP used to make exported goods may qualify if the claim otherwise qualifies. See AD/CVD drawback exclusion and how to file a duty drawback claim.

Action items

  • Pull May 4, 2025 entries: plasticizer, PVC compounding, and flooring/wire and cable importers of DOTP from these four countries confirm whether any entries dated May 4, 2025 now fall in the gap.
  • Confirm liquidation treatment with your broker for gap-period entries (May 4 through May 14, 2025 as we read the notices together).
  • Review protest/PSC timing if an entry liquidated with AD it should not have. Keep this general; check current protest and PSC rules for your entry.
  • Verify current deposit rates against the most recent administrative review segment, not only the order rates above.
