Aluminum foil sunset reviews: Commerce initiation and ITC institution (Oct 1, 2026)
First five-year reviews of the 2021 aluminum foil orders, plus magnesium, tissue paper, and thermal paper sunsets opened the same day.
Commerce automatically initiated five-year (sunset) reviews of several AD and CVD orders on October 1, 2026, including first reviews of aluminum foil from Armenia, Brazil, Oman, Russia, and Türkiye, plus CVD foil orders for Oman and Türkiye (91 FR 62467; FR Doc. 2026-20161). The ITC concurrently instituted aluminum foil five-year reviews (91 FR 62552; FR Doc. 2026-20139).

The aluminum foil orders date to November 12, 2021 (Commerce CVD orders on Oman and Turkey at 86 FR 62782; AD orders on Armenia, Brazil, Oman, Russia, and Turkey at 86 FR 62790). Sunset reviews ask whether revocation would be likely to lead to continuation or recurrence of dumping/subsidization (Commerce) and material injury (ITC) within a reasonably foreseeable time.
Deadlines that matter
At Commerce, domestic interested parties must file a notice of intent to participate within 15 days of publication or Commerce will revoke without further review. Complete substantive responses are due within 30 days. Entries of appearance for the public service list are requested within 10 days. At the ITC, responses to the notice of institution are due by November 2, 2026 (5:15 p.m.), and comments on response adequacy by December 8, 2026. Entries of appearance / APO applications are due no later than 21 days after Federal Register publication.
Sunset initiation does not change cash deposit rates by itself. Rates stay in place unless an order is revoked after the reviews. Importers of aluminum foil from the subject countries should track whether domestic industry intends to participate, because a no-show at Commerce triggers automatic revocation. Orders remain in force while reviews proceed.
