Algeria wire rod CVD order: 73.33% cash deposits, no ITC injury step
Commerce issued a CVD order on carbon and alloy steel wire rod from Algeria at 73.33% for SPA Algerian Qatar Steel and All Others. Why there is no ITC injury step, what is in scope, and why AD/CVD stays outside drawback.
Commerce has issued a final affirmative countervailing duty determination and CVD order on carbon and alloy steel wire rod from Algeria. The applicable date is September 18, 2026 (91 FR 59107; FR Doc. 2026-19107).
There is no ITC material injury step for this order. USTR has determined that Algeria is not a Subsidies Agreement country, so section 701(c)(1) of the Tariff Act does not require an injury determination before Commerce issues the CVD order.

Rates and cash deposits
Commerce assigned the following estimated countervailable subsidy rates:
SPA Algerian Qatar Steel: 73.33% (facts available with adverse inferences)
All Others: 73.33%
Suspension of liquidation continues; cash deposits equal to the subsidy rates from publication
Commerce intends to instruct CBP to continue suspension of liquidation for subject wire rod entered, or withdrawn from warehouse, for consumption on or after publication, and to require cash deposits equal to the rates above. The All Others rate covers producers or exporters not specifically listed.
Why there is no ITC injury determination
Under section 701(c)(1) of the Act, no material injury determination is necessary because USTR determined that Algeria is not a "Subsidies Agreement country" within the meaning of section 701(b). That USTR status notice is 90 FR 34334 (July 21, 2025). Commerce therefore issued the CVD order under section 705(c)(2) / 706(a) without an ITC injury finding.
SPA Algerian Qatar Steel did not participate, and the Government of Algeria did not provide requested information. Commerce relied on facts available with adverse inferences under sections 776(a) and (b). That single AFA rate also became the All Others rate under sections 703(d) and 705(c)(5)(A)(ii).
Scope snapshot
Subject merchandise is certain hot-rolled carbon steel and alloy steel wire rod in coils, of approximately circular cross section, less than 19.00 mm in actual solid cross-sectional diameter. Stainless, tool, high-nickel, ball-bearing, concrete reinforcing, and free-cutting steels meeting the stated exclusions are out. The FR appendix lists current HTSUS classifications including 7213.91.3011, 7213.91.3015, 7213.91.3020, 7213.91.3093, 7213.91.4500, 7213.91.6000, 7213.99.0030, 7227.20.0030, 7227.20.0080, 7227.90.6010, 7227.90.6020, 7227.90.6030, and 7227.90.6035. Entries under 7213.90.0090 and 7227.90.6090 may also be in scope if they meet the physical description. The written scope controls.
Drawback angle
AD/CVD cash deposits and assessed antidumping or countervailing duties are generally not drawback-eligible under 19 U.S.C. § 1677h and 19 CFR § 190.3.
