Commerce preliminarily determines that countervailable subsidies are being provided to producers and exporters of stationary and portable air compressors from China. Commerce relied in part on facts available and drew adverse inferences where respondents did not act to the best of their ability. Suzhou Alton received a rate based entirely on facts available. The only non-zero, non-de minimis, non-entirely-AFA company rate is FNA (Zhejiang) Co., Ltd. (FNZ) at 3.84%, which Commerce assigned as the all-others rate.

Suspension of liquidation

Under section 703(d)(2), Commerce will direct CBP to suspend liquidation of subject merchandise entered, or withdrawn from warehouse for consumption, on or after October 1, 2026 (publication date), and require cash deposits equal to the company-specific or all-others rates. If both producer and exporter have company-specific rates that differ, use the higher rate. Suspension remains in effect until further notice.

Final aligned with companion AD

At the petitioner's request (MAT Industries, LLC), Commerce is aligning the final CVD determination with the companion LTFV investigation. The final CVD determination is currently scheduled no later than February 10, 2027, unless postponed. Commerce intends to verify information relied on for the final.

Scope and HTSUS

Scope covers certain stationary and portable reciprocating (piston) air compressors, electric, gas, or battery powered, oil-free or oil-lubricated, with an integrated pressure vessel from 1 to 80 gallons, direct drive or belt driven, power roughly 373 W (0.5 HP) to 22.37 kW (30 HP). Includes unfinished compressors and third-country further processing that would not remove the merchandise from scope. Kits with accessories imported with the compressor are in scope; separately imported accessories are not. Excludes small inflators without an integrated tank (1 CFM or less), and rotary and dynamic compressors.

HTSUS convenience subheadings: stationary 8414.80.1615, 8414.80.1625, 8414.80.1635; portable 8414.80.1685. Written description controls. AD/CVD deposits remain generally outside drawback (AD/CVD drawback exclusion).
